This policy (‘Privacy Policy’) explains how Sherpa Australia Pty Ltd (ABN 24 168 403 307) (‘Sherpa PTY LTD’ or ‘us’) seeks to protect the Personal Information of individuals (users, Drivers and businesses).
Sherpa PTY LTD is committed to protecting the safety and security of the Personal Information of individuals whose information Sherpa PTY LTD has access to, including Sherpa Employees and users of the Sherpa PTY LTD Platform/Mobile apps (defined below) and other persons with whom Sherpa PTY LTD interacts (each a ‘User’ or ‘you’).
In providing the Sherpa Platform, we are sensitive to Users’ concerns about the safety of their Personal Information.

We care about your privacy: We will never rent, trade or sell your email address to anyone.

The Australian Privacy Principles

We will treat all personal information in accordance with all obligations that are binding upon us under the Privacy Act 1988 (Cth) (“Privacy Act”). The Privacy Act lays down 13 key principles in relation to the collection and treatment of personal information, which are called the “Australian Privacy Principles”.

Personal information held by the Company may include your:

  • name and date of birth;
  • residential and business postal addresses, telephone/mobile/fax numbers and email
    addresses;
  • bank account and/or credit card details for agreed billing purposes;
  • any information that you provided to us by you during your account creation process or added to your user profile;
  • preferences and password for using this site and your computer and connection information; and
  • any information that you otherwise share with us.

The Privacy Policy has been developed in accordance with the Privacy Act 1988 (Cth)(‘Act’). Under the Act, “Personal Information” is defined as:

In providing the Sherpa PTY LTD Platform, we are sensitive to Users’ concerns about the safety of their Personal Information.
In essence, Sherpa PTY LTD will typically only:

  • collect, use or share your Personal Information with your consent (unless it is not reasonable in the circumstances to obtain your consent and it is legally permissible for us to do so) or when required by a legal obligation; and
  • interact with your Personal Information in order to (a) provide you with the Sherpa PTY LTD Platform and information regarding associated goods and services; and (b) help us improve and develop Sherpa PTY LTD Platform and our service offering generally.

This Privacy Policy applies to you if you use our services or Website or App, including where you are a customer, or you are a courier providing delivery services to the customers. You provide us with personal information indicating that you have had sufficient opportunity to access this Privacy Policy and that you have read and consented to it.
If you do not wish to provide personal information to us, then you do not have to do so, however it may affect your use of this Site or any products and services offered on it. If you are a courier and do not wish to provide personal information to us, this may limit your ability to provide services to the customers.

COLLECTION OF PERSONAL INFORMATION

Personal information: The type of information we collect may include:

  • name;
  • images;
  • contact details including email address, address and telephone number;
  • credit card details;
  • address location for pickup and delivery of parcels;
  • GPS location during performance of delivery (if you are a courier);
  • any other information requested by us or provided by you;

We collect your personal information directly from you unless it is unreasonable or impracticable to do so. When collecting personal information from you, we may collect it in ways including:

  • through the information you provide when you sign up to be a customer or a courier with us;
  • through your access and use of our Websites, APP and social media;
  • when you log a delivery;
  • when you perform a delivery and when you have you GPS location service turned on;
  • during conversations between you and our representatives.

Your use of our websites: As with most online businesses, we may log information about your access and use of our websites, including using Internet cookies, your communications with our websites, the type of browser you are using, the type of operating system you are
using and the domain name of your Internet service provider.

Your opinion and feedback: We may contact you to voluntarily respond to questionnaires, surveys or market research to seek your opinion and feedback. Providing this information is optional to you. If we receive your personal information from third parties, we will protect it as set out in
this Privacy Policy.

  •  to contact and communicate with you;
  • for internal record keeping;

  • credit reporting agencies and courts, tribunals and regulatory authorities where customers fail to pay for goods or services provided by us to them;
  • courts, tribunals, regulatory authorities and law enforcement officers as required by law, in connection with any actual or prospective legal proceedings, or in order to establish, exercise or defend our legal rights;
  • third parties, including agents or sub-contractors, who assist us in providing information, products, services or direct marketing to us or to you. This may include parties located, or that store data, outside of Australia; and
  • third parties to collect and process data including Google Analytics or other relevant businesses. This may include parties that store data outside of Australia.

If there is a change of control of our business or a sale or transfer of business assets, we reserve the right to transfer to the extent permissible by law our user databases, together with any personal information and non-personal information contained in those databases. If you are a courier and you provide your us with your subcontractor’s details, you must ensure your subcontractor has read and agreed to this Privacy Policy.

Restrict: You may choose to restrict the collection or use of your personal information. If you have previously agreed to us using your personal information for direct marketing purposes, you may change your mind at any time by contacting us at the email address listed in this Privacy Policy.

Access: You may request details of personal information that we hold about you, in certain circumstances set out in the Privacy Act 1988 (Cth). An administrative fee may be payable for the provision of information. We may refuse to provide you with information that we hold about you, in certain circumstances set out in the Privacy Act.

Correction: If you believe that any information we hold about you is inaccurate, out of date, incomplete, irrelevant or misleading, please contact us by email. We rely in part upon customers advising us when their personal information changes. We will respond to any request within a reasonable time. We will endeavour to promptly correct any information found to be inaccurate, incomplete or out of date.

Complaints: If you believe that we have breached the Australian Privacy Principles and wish to make a complaint about that breach, please contact us by email setting out details of the breach. We will promptly investigate your complaint and respond to you in writing setting out the outcome of our investigation, what steps we propose to take to remedy the breach and any other action we will take to deal with your complaint.
